 Everyone wants to sell their home for top dollar,  fast and for the least amount of money.

Tip #17  On contracts and contingencies . . when are they enforceable? 

First things first. .a contingency is a condition inside a contract 

simple enough

If you are selling your home on your own, you should be familiar with this

So lets review what I think are the most common contingencies you will find. .

  • Financing Contingency 
  • Appraisal Contingency 
  • Home Inspection Contingency 
  • The sale of another property Contingency

There are others as well. .
You may find contingencies for Radon test, Mold Inspection, septic tank inspection. .
The point is that you are going to find all types of conditions  attached to the offer of purchase. .

An offer with fewer contingencies and a fair price should be more attractive for you than an offer with lots of conditions paying you a little more.

Can you negotiate a contingency?
Of course!
Inside a contract, everything is negotiable.

A great example would be to counter removing the sale of another property contingency.

As a listing agent advising my client, I would never relinquish the control of the sale to the marketing savvy of another agent or FSBO

What if their price is unrealistic?
Perhaps in another market. .
these days, 
I would think twice before accepting an offer with a sale of another property contingency

Nothing is set.. 
You should consider all offers.. 
It all depends on your goals and if you are willing to take a gamble on the sale of your house.
Remember
Don't  frown upon a contingency filled offer to purchase your home

If you feel that you need to make improvements to your home before selling it. . you must do the work before it goes on the market. .

not during!

Don't stage your house with paint buckets. .

Potential buyers are not interested in hearing about the repairs you will do if they buy your house. .

Your good intentions to look after defects you have ignored while you were the house owner reveals a lot about you as as seller

You've waited until the last moment and expect the best results?

When in reality, you have started the sale of your house in a negative way.

Depending on the price bracket of your house. .

Tip #15  How much deposit money should you ask from buyers? 

It is unreasonable for any buyer to ask a seller to take a house off the market without a reasonable deposit of good faith

Yes, there are contingencies in a contract and sometimes even this deposit becomes one.

You could have a contract where the "Good Faith deposit" will not be deposited into the closing agent's escrow account until all inspections have been cleared. 

In some cases, you may get an initial smaller deposit with the contract as they offer (the buyer) to pay an additional deposit when the inspection contingencies are completely cleared.


Just remember that  technically a good faith deposit is not of any consideration until the contract is violated or an agreement is reached to void the contract or finally the actual sale of the house occurs. .

You can't spend the deposit money. .even if you're the one holding on escrow. . until

What happens if your buyer backs out from the sale of the property by another reason NOT covered by any agreed 
contingency?


My advice is to be sure on this by speaking to an attorney. . .If the buyer believes otherwise. . this could potentially cost you time and money.

To protect yourself from any misunderstandings  sit down with the buyer and fully understand the conditions of the contract as you both agree to the terms

There are no gray areas here. .

Just to be sure. ..let me repeat it again. . talk to an attorney!


What happens if the good faith deposit money is not enough to cover the damages the buyer may have caused you?

There are no limits here. . and I know that the deposit amount is never one.

Tip #14  What to do when the Appraisal Comes in low . .HELP!!!!

You are not alone. .

I had to deal with this problem twice this month. .

Your options are limited

This is a very volatile market right now. .and 2013 seems to becoming the first year where appraisal results will need a drum roll!

Loose appraisals were a part of the problem when inflated prices were as common as loan approvals

Appraisal  complaints are rising now and there are ways how you can avoid the problem

Part of my advice is how to prevent appraisal  problems.

But what happens when you are facing the problem now?

Lets go step by step:

Challenge the appraisal. Find a recent comp that is not configured on the report.
Disputing an appraisal is not easy if you don't have the latest data of SOLD properties. .Zillow is not going to help you here.

You are better off consulting with a agent that has access to current market conditions.

Order an appraisal on your own.  Hire your own appraiser and hope that they will have value that is more helpful for you as a seller.

The caveat here is that most lenders when faced with two different appraisal they tend to choose the lowest . .not the highest. .but it may trigger for the lender to order a third appraisal if data is conflicting on the first two.


As a seller you hold a lot of clout. .specially if the house is a dream house for the buyers. .

Another possible solution is for your to carry a second note for the difference and still sell your house.
Of course the lender may not approve of this and the buyer, no matter how in love is with your house. . .may not agree to this terms. but is worth a try.


Ultimately, you need to face reality. . 
the appraiser does not set the price of your house. .. .the market does

Perhaps, you can compromise and meet the buyer to the terms of the appraisal. . after all, it may be the only choice you have.

Because if these tactics fail and you and the buyer can not agree to make up the shortfall in the appraised value, you may find yourself with a null contract. 
Most buyers are protected by a contingency clause in the sales contract, stating that the transaction can be terminated if the home doesn't appraise at, or above, the sales price.

So what are your choices then. . to put it back in the market and try to sell it for more that you know your house is worth?

After all. .

You need a team!
a team to help you 
get to the end of the sale. . 

Look, as much as you would like to do this alone, you still need a team to help you sell.

A buyers agent in this case is not the enemy. .
is a member of your team. .
They are out there looking for fresh buyers to bring them to your house.

They are the foot soldiers . .if you want to sell your house on your own. 

Welcome them!

But this post and advice is for another team member. .

Most sellers make the mistake to contact an attorney at the last minute. .after the contract gets ratified

No, no, no. .

You should go ahead and pick one and involve them to help you check the offers coming in. .

The incentive is there for them. . use their services becuase they are necessary;

Whether you are the buyer or the seller, it is important to understand your rights and duties and the obligations you are agreeing to in the contract that you sign.

Maryland has specific requirements for each real estate transaction but sometimes even local practice dictates how specific items are handled. .depending in what county the property is located,

Disclosures knowledge should be one place whee you need an attorney.
Failing to disclose and your deal can go bust at the closing table.

If you have to read the little print in the contract. .
with a magnifying glass. .
trying to understand it. .
you are probably already screwed!

Do it before. .
prepare 
and 
be aware. .
That it is to your advantage to hire an experienced real estate attorney, no matter which side of the closing table you will be sitting  on!
